Qld: Man sleeps on $15 million winning lotto ticket

By David Barbeler

BRISBANE, April 30 AAP - One of two $15 million winning Powerball tickets has spent
the night under its lucky - but anxious - owner's pillowcase.

Two winners from southeast Queensland shared first division in Thursday night's $30
million Powerball draw, but a second person has yet to put up his or her hand to claim
the other half of the massive prize.

The first, described as a professional Bayside man in his 50s, was hysterical when
he realised he had the winning numbers and spent an anxious night with the ticket never
leaving his side before visiting Golden Casket to claim his prize on Friday morning.

"We saw the draw on TV last night and we were just hysterical when we saw we had all
the numbers," the man said.

"We haven't slept a wink all night. It's a bit surreal. I can't feel anything at the
moment. It just doesn't feel real."

The man said he kept his 12-game Quickpick ticket, which cost just $8.35, in his pillowcase
overnight.

He said he was too overwhelmed by the enormity of the win to say exactly what they'll
do with the prize.

"We won't be rushing it. But we've been talking about buying cars, motorbikes, boats
and houses," he said.

"The only thing we're sure of is that we'll be helping out our family members."

The man purchased his winning ticket from Norfolk News in Ormeau, on the Gold Coast.

Golden Casket is still searching for the second $15 million winner who purchased their
winning ticket from Nextra Toombul News and Megabooks in the Toombul Shopping Centre.

"We have no idea who the mystery multi-millionaire from Toombul is as they didn't register
their ticket to a Winners Circle Card," Golden Casket spokeswoman Elissa Lewis said.

"Had they registered their ticket, we could have called them early this morning with
the news that they're now $15 million richer.

"It's possible that the winner is walking around completely unaware that he or she
is carrying the equivalent of $15 million cash."

The winning numbers were 15, 44, 20, 13 and 45. The Powerball was 11.

Fed: Surf club in focus as Garma cultural festival begin

By Vincent Morello

EAST ARNHEM LAND, NT, Aug 7 AAP - Australia's first indigenous surf lifesaving club
has only just been launched but it has already saved four people from the waters of east
Arnhem Land and set an inspiring example in the process.

More than 200 locals and interstate and overseas visitors gathered on Friday afternoon
at Shady Beach - a stunning section of coast beside the Aboriginal community of Yirrkala
on the Gove peninsula - for the official launch of the Walngawu Djakamirri surf lifesaving
club.

The launch coincided with the opening day of the annual Garma Festival of Traditional
Culture, a five-day event held at a nearby sacred site to celebrate the traditional culture
of the Yolngu people.

Federal Indigenous Affairs Minister Jenny Macklin is scheduled to speak at Garma on
Saturday but was on hand to congratulate the Yirrkala community and those who had made
the club a reality since 2007.

"Some of you might know that surfing is actually my number one passion," Ms Macklin
told the gathering.

"I don't get to do much of it and unfortunately I don't get to come to too many openings
of surf lifesaving clubs."

She said the community would benefit from the club in many ways.

"I know that you'll be fitter, stronger, healthier and you'll have a heck of a lot
of fun as a result of this surf lifesaving club."

Surf Lifesaving Northern Territory chief executive Tony Snelling said the club had
carried out four rescues in the 18 months since the program was created.

"One of the unfortunate realities is that indigenous people, particularly youth, are
over-represented in the drowning and the aquatic-injury statistics," Mr Snelling said.

"There is also a very sad reality that every year in Australia people drown trying
to rescue somebody else."

NT Chief Minister Paul Henderson was also at Shady Beach, where he announced that the
club, which operates out of a shipping container just up from the beach, would receive
an additional $25,000 in funding.

The club has 80 members aged 13 and older and expects to launch its nippers program
in late August.

"At the end of the day, it's all about community, it's all about children, it's all
about families - it's all about healthy activities and healthy lifestyles and keeping
our kids safe in the seas," Mr Henderson said.

The lifesaving association's president, Bob Creek, said the club was leading the way.

"I believe it to be a model for other coastal communities," he said.

"All those things we just spoke about ... and what's happening here very well could
be an opportunity for other coastal communities."

Garma, which will run until Tuesday, includes cultural, artistic and youth events.

Its main forum will allow indigenous leaders, academics and politicians to discuss
issues affecting Aboriginal communities.

Ms Macklin will speak on Saturday, when she is likely to face more criticism over the
joint commonwealth and NT government community housing policy.

Not one house has been completed under the Strategic Indigenous Housing and Infrastructure
Program launched 15 months ago.

Federal Environment Minister Peter Garrett and federal Indigenous Health Minister Warren
Snowdon will also speak at Garma on Saturday.

Package to get parliamentary approval =2

"I am willing to support the government's economic stimulus package," he told the Senate
after outlining details of a deal with the government.

"Ultimately, I was sent here to do a job and that job is to do whatever I can to assist
the hundreds of thousands of people along the (Murray-Darling) rivers."

While the deal had not given everyone what they wanted, it may have given them what
they need, he said.

"This morning, the treasurer and the water minister (Penny Wong) have agreed to a package
of $900 million in spending commitments including fast-tracking spending for the Murray-Darling-Basin,
for its economy over and above any previous commitments," Senator Xenophon said.

Senator Xenophon said there would be an additional $500 million brought forward during
the next three-and-a-half years for water buybacks, bringing the total spend to over $2
billion for that period.

There would be $200 million in grants to assist local communities in water saving and
planning for the future.

For the first time there would be a guaranteed $200 million for stormwater harvesting
projects, with the threshold for commonwealth contributions reduced from projects worth
$30 million to just $4 million.

Significant changes will be made to restrictions on emergency circumstances exit grant
packages, so that larger properties could qualify.

The previous restriction of 15 hectares is to be increased to 40 hectares or less.

"This increase will most likely see demand for exit packages increased," Senator Xenophon said.

Australian Greens leader Bob Brown, who negotiated a separate deal on the stimulus
package with the government, described Senator Xenophon's announcement as "a splendid
outcome".

"The opposition must be wondering how it missed the bus," he told the Senate promoting
jeers from coalition senators.

Family First senator Steve Fielding also announced he had won support from the government
for a $200 million pilot program for his jobs-building plan for local communities.

The plan will offer grants of up to $2 million in grassroots projects.

"It's a start," he said, referring to his earlier demand for $4 billion.

Fed: Aust will consider lottery system for sports funding, Rudd

The athletes aren't the only ones doing backflips after the Olympics.

Despite rejecting the idea just a few days ago .. the federal government now says it
will consider using money from lotteries to boost Olympic funding .. following Great Britain's
success at the Beijing Games.

KEVIN RUDD says the government will look at following the British model of using the
lottery system to fund sport programs.

A lack of funding has been blamed for Australia's slide down the Olympic table from
fourth in 2000 to sixth this year .. while Britain's jumped from 10th in 2000 and 2004
to fourth in Beijing.

Despite the idea being rejected when it was first raised .. the prime minister says
the idea's among the things to be considered when Sports Minister KATE ELLIS reviews funding.

Friday, February 9, 2007 -- Billing software company Amdocs has teamed up with computer giant IBM to offer two new solutions to help telecommunications companies in their customer service solutions.

The two companies will supply their "order to cash" system aimed at helping service providers reduce the cycle time and costs of delivering a new product after receiving a customer order, the companies said. Their "triple-play solution was designed to reduce time to market for new services, especially on bundled voice, data and video packages.

Tel Aviv-based broadband solutions provider Alvarion has been commissioned by telecommunications provider Ukrainian High Technologies to build the first commercial WiMAX network in the Ukraine using its BreezeMAX 3500 product. Following Alvarion's successful deployments in Kiev and Kharkov, UHT plans to use its exclusive IEEE 802.16 license in 3.5 GHz spectrum to extend its WiMAX network starting with Donetsk, Dnipropetrovsk, Odessa and Lviv, the companies said. Alvarion's local partner systems integrator S&T Soft-Tronik has performed system delivery, network deployment and will provide ongoing support for the project.

Beit Shemesh company Vringo launched its flagship product this week, bringing the popular video sharing trend to cellular phones with its new video ringtone technology.

The product, which is currently available by invitation only to private beta users, allows mobile users to share video clips by sending it as a ringtone when making a call.

"When you call your buddy they see your Vringo and you see theirs," said Dan Ciporin, Vringo chairman and former of Shopping.com. "Vringo creates a deeper form of communication as our users share viral videos with each call they make."

Funded by overseas angel investments of approximately $2 million to date, Vringo is expecting to go to market in the US and Europe around March, CEO Jon Medved told The Jerusalem Post, when it will offer the service directly to consumers and in partnership with mobile carriers.

Content will include both licensed material from TV, movies, and music videos as well as user generated clips, the company added.

As part of the launch, Vringo presented the service earlier this month at the AlwaysOn Media and Demo conferences in the US.

Comverse, a subsidiary of Comverse Technology, was selected by mobile operator Telecom Serbia to expand its SMS (short message service) options. Comverse will supply its Comverse SMS Personal and SMS Router to add SMS personalization capabilities and broaden SMS service options for telecom Serbia. Some of the capabilities it will provide include personal signature allowing users to create a signature and other text that appear automatically on outgoing SMS messages. Also, Comverse's SMS Auto Reply gives users the option to set up "out-of-office" messages that respond automatically to text messages that arrive when the user is too busy to answer.

Integrated application delivery solutions provider Radware has teamed up with Internet company Netvision Business for the systems assimilation and securitization in the upgrade of credit card company Leumi-card's Internet site. The project, which also entails building a new data center for Leumi Card is valued at NIS 6.5m., Tel Aviv- based Radware said.

Fed: 17 Australian police injured in Solomons, says Downer

CANBERRA, April 19 AAP - The number of Australian police injured in the Solomon Islands
has risen to 17 and Canberra is now likely to send the army back to the country, Foreign
Minister Alexander Downer says.

Fresh violence in the capital Honiara overnight, including the burning of shops and
other buildings, has forced the government to consider a military deployment, with a decision
due later this morning.

Initial reports had indicated eight officers had been injured in the violence.

Mr Downer said it now appeared likely Australian soldiers would be sent back to the country.

"We'll have to give very early consideration today to whether we send elements of the
army back there to restore order," he told ABC radio.

"We have quite a few troops on 24-hour standby in Townsville.

"We can send them pretty quickly and we'll be looking at that during the course of this morning.

"But there's a very good chance that on the basis of the advice we've now had from
Honiara that at least some troops will be sent there."

Mr Downer confirmed 17 Australian and two other members of the Regional Assistance
Mission to the Solomon Islands (RAMSI) had been injured in the riots.

It is understood one officer will be flown back to Australia on Friday for further treatment.

Barnum

Barnum, barnumism “It's the greatest show on Earth.” Very possibly. But who said it? Barnum himself, the mastermind of the Barnum & Bailey Circus, which later was merged to form part of Ringling Bros, and Barnum & Bailey Circus. Was Barnum being honest? Perhaps. But he is also reputed to have said, “There's a sucker born every minute.” And he never denied getting people moved out of his exhibit to make room for others by shouting, “Here's the way to the egress.” Those who followed his suggestion, expecting to see something, found themselves outside the exhibition hall and unable to return. And is it true that he whitewashed an ordinary elephant and paraded it as a white elephant from Siam? To be barnumized is to be classed as a sucker.

Phineas Taylor Barnum (1810–1891) was born in Bethel, Connecticut, the son of a farmer. He failed in several undertakings, but in 1835 he took the step that would make him one of the country's greatest impresarios. He began his career as a showman by successfully, but fraudulently, promoting Aunt Joice Heth as the nurse to George Washington. This made her at that time 162 years old, and yet thousands paid to see her. Barnum must have been right; a sucker is born every minute.

Barnum was first with many novel and exciting show pieces. He exhibited Tom Thumb, a twenty-five-inch midget. He brought over Jenny Lind, a Swedish soprano, calling her “The Swedish Nightingale.” He showcased Jumbo, the biggest elephant on earth, so he said (and gave a new word, Jumbo, to the American language), and his exhibit of the Siamese twins Chang and Eng was a constant source of wonder.

Barnum, America's most famous showman, relished fleecing the public (barnumism is a synonym for “humbuggery”) and didn’t object to his title “The Prince of Humbugs.”

Stardust back to life.

David Bowie is set to resurrect his Ziggy Stardust alter-ego. The 'Space Oddity' rocker is in talks with organisers of California's Coachella Valley Music and Arts festival, who want him to perform his classic album 'The Rise and Fall of Ziggy Stardust and The Spiders From Mars' in its entirety. A source said: "Coachella tried to book Bowie last year and he refused, so they got Prince to headline instead. But there's a very strong chance they'll be able to persuade him this year." The 62-year-old singer famously killed off his alter ego on stage in London in 1973, a year after the album's release. Bowie has been in semi-retirement since cancelling a 2004 world tour following a heart scare. He is currently believed to be working on new material in Germany following a comment left under his name on social networking web site Twitter. A user named David Bowie wrote: "Cheers from a snowy Berlin! Working on some new material." David's last studio album 'Reality' was released in 2003. Last year, he sang backing vocals on Scarlett Johansson's album 'Anywhere I lay My Head'.

Bold Software and the e-tailing group Release Third Annual Live Chat Effectiveness Research Report.

Wichita, KS (PRWEB) May 12, 2011

Bold Software, a leading provider of world-class web communication tools, and the e-tailing group, an e-commerce consultancy, today announced the third annual release of the industry's most comprehensive research on the effectiveness of live chat technology.

With a foreword and industry insights on survey methodology from recognized ecommerce consultancy the e-tailing group (who participated in the research for the first time), the 2011 findings include compelling insights for internet retailers, such as the fact that one in five shoppers prefers live chat more than any other communication method. Further, these live chat advocates are a highly desirable population, one that typically has a higher household income than average and spends more online per year than other shoppers.

"We're proud to share these findings with the market for the third year in a row," said Bold Software President and CEO Steve Castro-Miller. "We undertook this for the first time back in 2009 in order to glean shopper insights around the effectiveness of live chat as a tool, and our research has evolved each year. This year, for example, we wanted to better understand shopper perceptions around proactive chat. We uncovered critical information for e-tailers around how to -- and how not to -- implement this valuable tool. Additionally, we've seen growth in the UK market and so the report also takes a closer look at this customer segment for the first time."

Earlier this year, Bold Software and the e-tailing group collaborated on a blind survey of more than 1,000 regular internet shoppers using an opt-in, third party panel. Out of this live chat research, five key conclusions can be drawn:

1) 20% of shoppers prefer live chat. There is an identifiable and significantly-sized population of internet buyers that want -- more than any other communication method for any circumstance or situation -- to engage in a live chat when communicating with an internet retailer.

2) The population that prefers live chat is a highly desirable one. Those that pick live chat as their communication method have a significantly higher positive attitude about the technology's presence on a website. These live chat advocates are more likely to trust websites that have live chat and more likely to buy simply because of its presence. Further, this live chat user is aged 31-50, has considerably higher household income than average, is more likely to be college educated, and spends more money online per year than other groups of shoppers.

3) Receptiveness to proactive chat is on the rise, but care in execution is required. The majority of respondents, even more than the year prior, welcome being invited to chat. That said, a number of survey takers noted that they've left websites because of poor invitation practices.

4) Best practices generally fall into three categories with the "human factor" of chat at the top. Chatters confirmed what many merchants believe -- the people taking the chats, particularly their knowledge and speed, are the key determinants of a successful chat. Visitors also cite the ability for their browser to be directed by an agent, full co-browsing capabilities, and judicious use of canned messages as important.

5) Shoppers in the UK are similar -- and different -- from their US counterparts when it comes to live chat. While UK respondents agree with US shoppers on what makes a live chat session successful, and generally have a positive attitude toward the technology, they are less enthusiastic. For instance, the UK has half as many live chat users as the US does. This poses an interesting opportunity for firms doing business in the UK and wanting to engage with on-site visitors in sales-related situations.

Lauren Freedman, president of the e-tailing group, commented, "I believe we are at the cusp of live chat's importance, where a range of marketers are now seeing its full potential. Positive consumer experiences and revenue-generating performance results will once again be the impetus to enhanced utilization, and here strategic planning and smart execution are certain to deliver. My own cynicism has faded, and I, too, have fully embraced live chat's potential, recommending that all retailers evaluate the tool for their own brand and customer base."

Comments on the Quarter

"LeCroy's momentum continued into the third quarter of fiscal 2011 as we reported our second consecutive quarter of record revenues, orders and non-GAAP operating income," said President and Chief Executive Officer Tom Reslewic. "Revenues of $46.5 million grew by 3% from the seasonally-strong second fiscal quarter, making this our eighth consecutive quarter of sequential revenue growth. On the bottom line, we grew non-GAAP EPS 113% year-over-year to $0.32 primarily as a result of the strong operating leverage in our business."

"Non-GAAP gross margins for the quarter increased 160 basis points to 61.6%," added Reslewic. "This is especially impressive given the number of new products we launched during the quarter, which creates a temporary increase in cost of goods sold. We launched a mid-range oscilloscope, the WaveRunner 6 Zi, which surpassed industry benchmarks for performance and price and is rapidly gaining traction in the market. On the high end, we launched the WaveMaster 845 Zi, the world's highest bandwidth oscilloscope that received top honors at DesignCon 2011. We also began producing demo units for LabMaster 9 Zi-A Multi-channel Oscilloscope System, the industry's highest bandwidth multi-channel oscilloscope system, in preparation for its launch in the current quarter."

GAAP operating income for the third quarter of 2011 includes a $5.7 million non-cash share-based compensation charge of which $5.4 million is attributable to stock appreciation rights ("SARs"). Accounting for SARs requires the recording of an expense or income to the consolidated statements of operations depending on whether the Company's stock price increased or decreased, respectively. Because of the continued rise in LeCroy's stock price during the third quarter of fiscal 2011, the Company recorded a significant, primarily non-cash, mark-to-market share-based compensation expense for the SARs.

Outlook and Guidance

"Our new products continue to be extremely well received by the market and we believe the demand environment will continue to remain solid for the foreseeable future," said Reslewic. "LeCroy is well-prepared to capitalize on that demand with a strong pipeline of industry-leading products that will be introduced in the coming quarters. Going forward, our goal is to build on our strong momentum to explore and pursue opportunities for continued solid growth. We expect fiscal 2011 will close as a record year in the Company's history."

"For the fourth quarter of fiscal 2011, we currently expect to report revenues of approximately $47 million and non-GAAP operating margin of approximately 16%," concluded Reslewic.

Conference Call Information

LeCroy will broadcast its quarterly conference call for investors live over the Internet today, Wednesday, April 27, 2011 at 10:00 a.m. ET. About LeCroy Corporation

LeCroy Corporation is a worldwide leader in serial data test solutions, creating advanced instruments that drive product innovation by quickly measuring, analyzing and verifying complex electronic signals. The Company offers high-performance oscilloscopes, serial data analyzers and global communications protocol test solutions used by design engineers in the computer, semiconductor and consumer electronics, data storage, automotive and industrial, and military and aerospace markets. LeCroy's 45-year heritage of technical innovation is the foundation for its recognized leadership in "WaveShape Analysis" - capturing, viewing and measuring the high-speed signals that drive today's information and communications technologies. LeCroy is headquartered in Chestnut Ridge, New York. Company information is available at http://www.lecroy.com.

Basis of Presentation

The Company's fiscal years end on the Saturday closest to June 30, resulting in an additional week of results every five or six years. The fiscal year ended July 3, 2010 represented a 53-week period, while the fiscal year ending July 2, 2011 will represent a 52-week period. Therefore, the first three quarters of fiscal 2011 was a 39-week period compared with a 40-week period for the first three quarters of fiscal 2010.

The consolidated balance sheet as of July 3, 2010 reflects a correction of approximately $0.9 million to properly classify the deferred tax asset related to the Company's stock appreciation rights ("SARs"). The Company's SARs are liability classified awards and are reflected on the consolidated balance sheet as current liabilities. Therefore, the deferred tax asset associated with these awards, which was previously classified as non-current as of July 3, 2010, has been reclassified from Other non-current assets to Other current assets to follow the current classification of the underlying award.

Safe Harbor

This release contains forward-looking statements, including those pertaining, but not limited to expectations regarding: LeCroy's expectation that its new products will continue to be extremely well received by the market and the belief that the demand environment will continue to remain solid for the foreseeable future; LeCroy being well-prepared to capitalize on that demand with a strong pipeline of industry-leading products that will be introduced in the coming quarters; the goal to build on LeCroy's strong momentum and to explore and pursue opportunities for continued solid growth; and LeCroy's expectation that fiscal 2011 will close as a record year in the Company's history; and LeCroy's anticipation to report revenue of approximately $47 million, and non-GAAP operating margin of approximately 16% for the fourth quarter of fiscal 2011.

Actual performance and results of operations may differ materially from those projected or suggested in the forward-looking statements due to certain risks and uncertainties including, without limitation, adverse changes in general economic or political conditions in any of the major countries in which LeCroy does business; volume and timing of orders received; changes in the mix of products sold; competitive pricing pressure; the availability and timing of funding for the Company's current products; delays in development or shipment of LeCroy's new products or existing products; introduction of new products by existing and new competitors; failure to successfully manage transitions to new markets; failure to anticipate and develop new products and services in response to changes in demand; failure to obtain and maintain cost reductions; difficulty in predicting revenue from new products; disputes and litigation; inability to protect LeCroy's intellectual property from third-party infringers; failure to manage LeCroy's sales and distribution channels effectively; disruption of LeCroy's business due to catastrophic events such as the earthquake and tsunami in Japan and other collateral events; risks associated with international operations; fluctuations in foreign currency exchange rates; changes in, or interpretations of, accounting principles; inventory write-down; impairment of long-lived assets; valuation of deferred tax assets; unanticipated changes in, or interpretations of, tax rules and regulations; LeCroy's inability to attract and retain key personnel; LeCroy's inability to purchase its convertible debt; and interruptions or terminations in LeCroy's relationships with turnkey assemblers.

For further discussion of these and other risks and uncertainties, individuals should refer to LeCroy's SEC filings, which are available at the Company's website www.lecroy.com. The financial information set forth in this press release reflects estimates based on information available at this time. These amounts could differ from actual reported amounts stated in LeCroy's Quarterly Report on Form 10-Q for the quarter ended April 2, 2011, which the Company expects to file in May 2011.

LeCroy undertakes no obligation to publicly update forward-looking statements, whether because of new information, future events or otherwise. Further information on potential factors that could affect LeCroy Corporation's business is described in the Company's reports on file with the SEC.

Use of Non-GAAP Financial Measures

Certain disclosures in this press release include "non-GAAP financial measures." A non-GAAP financial measure is defined as a numerical measure of a company's financial performance, financial position or cash flows that excludes or includes amounts so as to be different from the most directly comparable measure calculated and presented in accordance with GAAP in the Consolidated Balance Sheets, Consolidated Statements of Operations or Cash Flows of the Company.

The non-GAAP results are a supplement to the financial statements based on generally accepted accounting principles ("GAAP"). The Company believes this presentation provides investors and LeCroy management with additional insight into its underlying results because of the materiality of certain non-cash charges. The Company excludes these expenses when evaluating core operating activities and for strategic decision making, forecasting future results and evaluating current performance.

We define non-GAAP gross profit as gross profit as reported under GAAP plus non-cash charges for share-based compensation costs included in cost of revenues. Non-GAAP gross margin is computed as non-GAAP gross profit as a percentage of total revenues. Non-GAAP gross profit and non-GAAP gross margin are not substitutes for comparable GAAP measures.

We define non-GAAP operating income as operating income reported under GAAP plus primarily non-cash charges for share-based compensation costs and business realignment charges. A portion of our stock-based compensation expense was the result of SAR exercises for cash. Non-GAAP operating income is not a substitute for GAAP operating income.

GAAP net income for the three quarters ended April 2, 2011 includes an approximate $0.5 million loss on the extinguishment of convertible notes. Accounting for the extinguishment of convertible notes requires the application of derecognition guidance where upon repurchase, the fair value of the liability component immediately prior to extinguishment is measured first and the difference between the fair value of the aggregate consideration paid and the fair value of the liability component is attributed to the reacquisition of the equity component. The derecognition guidance results in a loss or gain in the consolidated statement of operations that differs from the cash loss or gain, which is measured as the difference between the cash paid and the principal amount repurchased. The after-tax impact resulting from the difference between the cash loss and the accounting loss is approximately $0.2 million.

We define non-GAAP net income as net income (loss) reported under GAAP plus primarily non-cash charges for share-based compensation costs, business realignment charges, non-cash amortization of debt discount and non-cash loss on extinguishment of convertible notes, each net of applicable income taxes, such that the effective blended statutory rate, for non-GAAP net income is approximately 38% and 28% on a year-to-date basis, adjusted for tax return filing true-ups and reserve adjustments, for each of the full fiscal 2010 and 2011 years, respectively. Non-GAAP net income is not a substitute for GAAP net income (loss).

We define non-GAAP net income per diluted common share as non-GAAP net income divided by the weighted average number of shares outstanding plus the dilutive effect of stock options, restricted stock and the convertible notes, calculated consistent with GAAP, as applicable. Non-GAAP net income per diluted common share is not a substitute for GAAP net income (loss) per diluted common share.

Non-GAAP gross profit, non-GAAP gross margin, non-GAAP operating income, non-GAAP operating margin, non-GAAP net income and non-GAAP net income per diluted common share, as we defined them, may differ from similarly named measures used by other entities and, consequently, could be misleading unless all entities calculate and define such non-GAAP measures in the same manner. A presentation of, and a reconciliation of, our non-GAAP financial measures with the most directly comparable GAAP measures are included in the accompanying financial data. By definition, non-GAAP measures do not give a full understanding of LeCroy; therefore, to be truly valuable, they must be used in conjunction with the GAAP measures. We strongly encourage investors to review our consolidated financial statements and publicly filed reports in their entirety and not rely on any single financial measure.
